Many unions and staff associations in Scotland have schemes in place for their members under which the legal fees and other costs incurred by a member in pursuing a personal injury claim are met. Some schemes extend this benefit to include the member’s husband/wife/partner and close relatives.

The rules differ from scheme to scheme and, if you are a member of a union or staff association and you think you may have a right to claim accident compensation in Scotland, you should consult with your local representative as soon as possible.

To qualify for help under a scheme, you may need to use the services of a solicitor chosen for you by the union/staff association and, in view of the recent adverse publicity surrounding some of the arrangements made between unions and legal firms in England (and, in some cases, for other reasons), not everyone is comfortable with that. If you feel that way, there is no reason why you can’t opt to use one of the other funding arrangements in connection with your compensation claim, although you will not be able to obtain civil legal assistance.
