THE COST? - PRIVATE ARRANGEMENT
It is, of course, possible to negotiate specific terms of engagement with a solicitor in Scotland in relation to taking forward your particular compensation claim. This is known as a private arrangement.
Private arrangements are commonly used for more complex cases or cases where the likelihood of success is difficult to assess, in circumstances where one of the other funding arrangements is unavailable or less appropriate.
There is a common misconception that lawyers are prepared to take every type of compensation case forward under a no win no fee agreement. That is not so. A solicitor is only likely to agree to act for you on that basis if he/she believes that there is a reasonable prospect of success within a reasonable timeframe. Some types of compensation claim are, by their nature, more complicated, more time-consuming and more drawn-out than others (medical negligence claims being a good example) and, quite understandably, solicitors are often reluctant to take those types of cases on a speculative basis.
