the role of SC
ScottishCompensation.com ("SC") does not provide (and will not be deemed to have provided) legal advice. Advice of that nature will only be provided to you by the particular solicitors that SC puts you in contact with (“the Solicitors”) if they choose to act.
The sole functions of SC are: (1) through the medium of this website and otherwise, to provide general information; and (2) to put you in contact with the Solicitors who may (or may not) opt to act in relation to your claim. SC will not charge you for doing either of these things. SC may receive payment in respect of certain services provided to the Solicitors in respect of your claim but, if that happens, the Solicitors have an obligation to SC not to recharge that to you as an expense.
The information provided by SC (whether through the medium of this website and/or otherwise) is general information only and:-
- no part of it represents (or shall be deemed to represent) legal or other professional advice;
- no reliance should be placed on it (or any part thereof) for any purpose whatsoever; and
- SC shall not be liable in respect of it (or any part thereof) on any basis whatsoever (whether in delict, tort, contract or otherwise).
No liability is accepted for any harm that may be caused to your systems or data by using this website. Whilst SC seeks to ensure that it is free from viruses and inappropriate material, it is your responsibility to scan for viruses and inappropriate material.
the role of the Solicitors
The Solicitors will provide you with legal advice about your claim. If the Solicitors agree to act for you on a “no win, no fee” basis, they will do so under a “Written Fee Charging Agreement”. That is a type of agreement allowed by the rules of the Law Society of Scotland and it will set out the basis upon which the Solicitors will act for you.
The terms of your Agreement with the Solicitors (whether that is a Written Fee Charging Agreement or otherwise) will create the solicitor/client relationship between you and its content is entirely between you and the Solicitors (SC is not a party to the Agreement and shall have no responsibility or liability for its terms on any basis whatsoever).
The Solicitors will discuss your claim with you (including the amount of compensation you may receive and the process/timescales involved) and explain the basis upon which they will charge for their work and the expenses involved.
fees and expenses
SC will not charge you anything, win or lose.
If the Solicitors agree to act for you on a “no win, no fee” basis, they will receive no fee unless your claim is successful and they will have an obligation to SC to put a limit on the amount of their fee even if one is due. That means you maximize the compensation you receive.
The Solicitors will discuss with you the responsibility for the “other side’s” legal fees if your claim is unsuccessful and the availability of insurance to cover that risk.
The Solicitors will also discuss with you the expenses that are likely to be incurred in relation to your claim and who will have responsibility for those (both if you win and if you lose).

When you ask for information via this site, we capture certain personal information (eg your name, address, e-mail address, home telephone number, etc) that you supply. All of that information is processed in accordance with the Data Protection Act 1998 and your details are entered into SC’s database for general administration purposes. We have security policies in place to protect the personal data that we hold about you.
By submitting personal information to SC, you shall be deemed to have authorized us to release it to all or any of the solicitors with whom we deal. Save for those solicitors and/or any other party to whom we are required to make disclosure by law or regulation, we will not pass your details to anyone else outside SC without your permission.
If you ask us to do so in writing, we will provide you with a copy of your personal information which we have collected through this website. We do, however, reserve our right under the data protection legislation to charge a fee for doing so.
To improve our understanding of how this website is used, we keep a record of which pages are accessed by users. That information does not identify individuals and is not linked to any personal information which we collect. The information is stored on our own IT network.
governing law
These terms and conditions shall be governed by and construed in accordance with the laws of Scotland and you agree that, in the event of any dispute, the matter may be dealt with only by the Scottish courts.
