ROAD ACCIDENT - UNINSURED DRIVER
Recognising that all drivers of motor vehicles have a potential liability to pay compensation and the need to make sure that there is money readily available for those harmed, the law makes it compulsory for drivers to have insurance that covers liabilities flowing from the death, personal injury or property damage of a third party. This is known as “third party insurance.” Unfortunately, however, not everyone obeys the law and some choose to drive without this insurance.
In circumstances where someone suffers an injury (whether a bodily injury or property damage) in a road accident in Scotland and has a right to compensation but can’t get it because the wrongdoer is uninsured, it may be possible to receive payment instead from an organisation called the Motor Insurers’ Bureau.
There are strict rules that need to be followed before a MIB claim will succeed (for example, the uninsured wrongdoer needs to be sued in court) and some people are not eligible to receive payment under the scheme (for example, a car passenger who knows that the car being travelled in is not properly insured). There is a limit on the amount that the MIB will pay out and excesses do apply in some circumstances.
