Players and spectators injured during a sporting event in Scotland, may, in certain circumstances, be entitled to compensation.

The general position is that a player taking part in a sporting activity will not have a valid sports injuries compensation claim in Scotland if he/she is injured by something that is within the normal rules of the particular sport. Instead, any right to compensation that a spectator is likely to have will be against the organiser of the event in question and be based on a breach of a duty of care owed to him/her by that organiser. In those circumstances, it won’t be necessary to show that the organiser intended any harm. It will be enough to show that it was at fault.
