In Scotland, if someone is supplied with a faulty product which causes:-
- a physical injury; and/or
- property damage (to something other than the faulty product itself – there are separate rules dealing with that);
he/she may be entitled to compensation.
This is a very complex area in Scottish law. In some circumstances, only the manufacturer of the product will be liable, whilst in other cases, the retailer and distributor will be liable too. In some circumstances, it’s necessary to prove negligence but, in other cases, it’s not.
