Victims of violent crime in Scotland may be entitled to compensation from the perpetrator. It is often the case, however, that the perpetrator (even if traced) has no assets with which to pay compensation and, instead, the victim needs to apply for compensation under the Criminal Injuries Compensation Scheme.
The Criminal Injuries Compensation Scheme is designed to help “innocent victims” of crime and, reflecting that ethos, compensation payments are adjusted to reflect, amongst other things, any criminal history that the applicant may have and the degree of cooperation given to the police by the applicant in connection with the crime in question.
The Scheme is intended to compensate only those suffering serious injury. Claims that would result in payouts of less than £1,000 are not eligible under it.
