ACCIDENT AT WORK - FARM

The agricultural industry is a very dangerous environment with annual fatality rates that rank amongst the worst in Scotland. Most years, between 5 and 10 people are killed in farm accidents in Scotland and another 70 or so suffer major injuries.

Workers in the farming industry face a broad range of potential hazards in the workplace. These include, amongst many others:-

  • using farm vehicles, often in dangerous circumstances that involve lone working (there are frequent occurrences of a farm worker being involved in a tractor accident whilst working alone)
  • handling fertilizers, pesticides and other potentially dangerous chemicals
  • working with livestock
  • lifting heavy loads and other manual handling operations
  • using dangerous equipment (often with several moving parts, cutting blades, etc)
  • working at height (often with unstable loads)
  • working with/near silos, slurry pits, etc

The employers of farm workers in Scotland owe the same general and statutory duties to their employees as other employers. If you are a farm worker, a breach of any of those duties by your employer which results in you having a farm accident in Scotland or otherwise suffering personal injuries, may entitle you to compensation.

Similarly, a member of the public who is injured as a result of an accident on a farm in Scotland may also be entitled to compensation. The occupiers’ liability rules apply to farms in the same way as they apply to accidents in other places.
